What the fee depends upon
Value and complexity
The value of the estate, trust or claim and the number of issues in dispute.
Mediator selected
Fees vary between mediators according to experience and availability.
Duration
Whether a half day or a full day is appropriate, and any additional preparation time.
Format
Whether the mediation takes place online or in person, and any venue costs.
Number of parties
Multi-party estate and trust disputes generally require more preparation and time.
Documents
The volume of the mediation bundle and any expert material to be read in advance.
Fixed-fee quotations
Once we have brief details of the dispute, the number of parties and the likely duration, we will provide a fixed-fee quotation covering the mediator's preparation and the mediation itself, so that the parties know the cost in advance.
How the fee is shared
Where appropriate the mediation fee can be divided equally between the parties, although the parties are free to agree another arrangement — for example a different split, payment by one party, or payment from the estate or trust fund where that is properly authorised. Each party normally bears its own legal costs of attending.
Other costs
In person mediations may involve venue hire, catering and travel, which are quoted separately. Online mediations avoid those costs. VAT is charged where applicable.
